Merge Momentum Terms and Conditions

The Merge Momentum package is designed to help small to medium businesses stay consistent online through managed marketing support, including social media content, email newsletters, website blogs, campaign content and reporting.

By signing up to a Merge Momentum package, you agree to the following terms and conditions.

Minimum Commitment

Merge Momentum has a minimum commitment of 3 months.

This allows enough time to properly set up your systems, understand your business, create consistent content, build momentum and start reviewing early marketing performance.

After the initial 3 month period, your package will continue on a monthly basis unless cancelled in writing.

Setup Fee

A one time setup fee of $1,495 + GST applies when we first create and organise your GoHighLevel account.

This setup fee covers the initial setup of your client sub account, importing contacts, organising lists and tags, connecting email marketing tools, linking social media accounts where required, setting up your newsletter layout and preparing the system so your monthly marketing activity can begin properly.

The setup fee is payable before setup work begins and is non-refundable once work has started.

Monthly Package Fees

Monthly package fees are charged in advance and are payable before work begins for that month.

Current package pricing is:
Core Package, $999 + GST per month
Growth Package, $1,999 + GST per month

Any additional work outside the agreed package inclusions will be quoted separately or charged at our standard hourly rate of $170 + GST, with your approval.

What Is GoHighLevel?

GoHighLevel is a CRM (Customer Relationship Management) marketing platform we use to help manage your online marketing in one place.
It can be used for email marketing, contact lists, enquiry forms, landing pages, automations, social media scheduling, customer follow ups, basic reporting and campaign tracking.

For the Merge Momentum package, we use GoHighLevel to help organise your marketing activity, send your email newsletters, manage contacts, schedule content where suitable and keep your campaigns running more smoothly.

GoHighLevel is not owned by Merge Media. It is a third party platform, which means its features, pricing, access, outages, updates and technical changes are controlled by GoHighLevel.

GoHighLevel Subscription

For both packages, the GoHighLevel sub account subscription of $30 + GST per month is included.

This subscription gives your business access to a GoHighLevel sub account managed under Merge Media’s agency account. This allows us to help organise and manage your marketing activity from one central place.

If you downgrade, pause or cancel your Momentum Package, access to the GoHighLevel sub account may also end unless a separate subscription arrangement is agreed.

The GoHighLevel platform is provided by a third party, so any outages, technical changes, price changes, feature changes or platform restrictions are outside of Merge Media’s control.

What Is Included

Your monthly inclusions depend on the package you choose.

The Core Package includes weekly social media content (1 post per week), one monthly email newsletter and one monthly blog post.

The Growth Package includes additional social media content, a larger monthly email newsletter, a monthly blog post, one monthly campaign or ad graphic, a 6 monthly keyword ranking report, and a monthly marketing report to quantify your marketing spend.

Paid advertising spend is not included in the monthly package fee. Any Meta, Google, LinkedIn or other advertising platform spend is paid separately by the client, directly to the platform where possible.

Revisions

Each monthly package includes a reasonable amount of revision time for content before it is finalised or scheduled.

Email newsletters include up to 15 minutes of revisions per newsletter.

Social media content includes up to 15 minutes of revisions per batch of posts.

Ad campaign graphics or campaign content include up to 15 minutes of revisions per campaign.

Any additional changes beyond the included revision time may be charged at our standard hourly rate of $170 + GST, with your approval. This helps keep the monthly packages running smoothly and makes sure larger changes are allowed for properly.

Client Responsibilities

To keep your marketing moving, you agree to provide any information, images, offers, updates, approvals, logins or access we reasonably need to complete the work.

This may include website access, social media access, GoHighLevel access, Google Analytics access, Google Business Profile access, brand files, images, product or service information, customer lists and newsletter content.

If we are waiting on information, access or approval, this may delay content creation, scheduling, email sending or reporting.

Content Approval

We will create content based on the information you provide, your website, your brand, your previous marketing and our understanding of your business.

Where approval is required, content must be reviewed within a reasonable timeframe. If approval is delayed, scheduled content or email newsletters may also be delayed.

If you ask us to post or send content without approval, you accept responsibility for checking that the information provided to us is correct, including prices, dates, offers, product details, claims and contact details.

Email Marketing and Contact Lists

You are responsible for ensuring that any email contacts supplied to us have been collected legally and can be used for marketing communication.

You must only provide contacts who have agreed to receive marketing from your business, or where you have a valid reason to contact them under relevant email marketing laws.

Merge Media is not responsible for the quality, accuracy, consent status or legality of client supplied email lists.

Blog Content and Website Updates

Blog content is written to support your brand, website activity, Google visibility and AI search where suitable.

While we aim to write useful, keyword-focused content, we cannot guarantee specific rankings, traffic levels, enquiries or sales.

Where blog posts are added to your website, you are responsible for ensuring the technical setup of your website allows us to publish content safely and correctly. If website issues, plugin conflicts, hosting problems or access restrictions affect publishing, extra work may be charged separately. If we already look after your site and built it for you, website integration is less complex.

Social Media Content

Social media content is created to help your business stay visible, consistent and on brand.

We cannot guarantee reach, engagement, followers, enquiries or sales from social media activity, as results depend on your audience, industry, budget, platform algorithms, offer strength and market conditions.

Any boosted posts or paid social media campaigns require separate ad spend.

Paid Campaigns

Where your package includes a monthly campaign or ad graphic, this includes the creative, caption or ad copy and setup or scheduling where suitable. Advertising spend is not included.

The client is responsible for approving campaign details, budgets, dates, offers and targeting before any paid campaign goes live.

While we are confident our packages will make a difference to your bottom line, Merge Media does not guarantee the performance of paid campaigns, including clicks, leads, bookings, conversions or sales.

Reporting

Reports are provided to help you understand how your website, content, email marketing and online activity are performing.

Reports may include website traffic, engagement, enquiry trends, email open rates, email clicks, social media reach, keyword movement or other relevant marketing activity.

Reporting is based on the data available through connected platforms such as Google Analytics, GoHighLevel, social media accounts and other agreed tools.

Because third-party platforms may change how they track or display data, reporting figures may vary or be limited by the tools available.

Results and Guarantees

Merge Momentum is designed to improve consistency, visibility, communication and marketing activity over time.

We do not guarantee specific results, including search rankings, social media reach, email open rates, website traffic, enquiries, bookings, sales or revenue.

Marketing results depend on many factors, including your industry, competition, existing audience, offer, website, customer demand, ad budget and market conditions.

Cancellations

After the initial 3 month minimum term, you may cancel your Merge Momentum package by giving written notice.

One full calendar month’s notice is required for cancellation.

Any work already completed, scheduled or invoiced remains payable.

If you cancel part way through a month, no refund will be given for that month.

Pausing Your Package

Packages cannot usually be paused during the initial 3 month minimum term.

After the initial term, a pause may be considered by agreement, depending on the reason and the work already scheduled.

If a package is paused, access to GoHighLevel, scheduled content, reporting or other services may also be paused.

Ownership of Content

Once all invoices have been paid in full, you own the final approved content created specifically for your business as part of your package.
This includes final social media graphics, captions, email newsletter content and blog content.

Merge Media may retain ownership of working files, templates, strategy documents, design files, system setups, processes and any internal tools unless otherwise agreed in writing.

Use of Work in Our Portfolio

Unless you request otherwise in writing, Merge Media may display completed work, screenshots, campaign examples, social media graphics, website content, blog examples or general results as part of our portfolio, website, social media, proposals or case studies.

We will not share confidential business information without permission.

Third Party Platforms

Merge Media may use third party platforms including GoHighLevel, Meta, Instagram, Facebook, LinkedIn, Google Analytics, Google Search Console, email marketing tools, website plugins and other systems.

We are not responsible for outages, restrictions, account suspensions, platform errors, algorithm changes, data changes, deliverability issues or technical problems caused by third party platforms.

Payment Terms

Invoices are payable by the due date stated on the invoice. Invoices are sent on the 30th of each month, payable on the 20th of the following month.

If payment is overdue, Merge Media may pause work, scheduling, email sending, reporting or access to services until the account is brought up to date.

Ongoing late payment may result in cancellation of your package.

Changes to Packages

Merge Media may update package inclusions, pricing or terms from time to time.

Existing clients will be given notice of any significant changes before they take effect.

Agreement

By accepting a Merge Momentum package, paying the setup fee or approving the start of work, you confirm that you have read and accepted these terms and conditions.
